
Terms of Service
Here is exactly what you get, what it costs, and how we work together.
1. Project Valuation and Pricing
Website and digital delivery projects may be valued up to N$10,000 or more depending on approved scope, complexity, technical requirements, content readiness, and delivery demands.
Projects may be priced either by approved scope or by an hourly estimate, depending on the nature of the work. Final pricing is confirmed after review of requirements, delivery expectations, and project fit.
2. Payment Plans and Billing Structure
Flexible installment options may be available for qualified projects, subject to project scope, internal approval, and payment risk assessment.
Payment plans do not include unlimited revisions, unlimited monthly work, unlimited availability, or unlimited support. If agreed payments are missed, work may be paused until the account is brought back into good standing.
3. Scope of Work
All projects are governed by an agreed scope before development begins. That scope may define deliverables, page count, revisions, timeline assumptions, launch support, and any included post-launch items.
Work outside the agreed scope is quoted separately and may be billed hourly, by milestone, or by a revised scoped estimate.
4. Revisions and Corrections
Unless otherwise stated in writing, projects include two major revision rounds during the active build phase and one small post-launch correction window for minor defects or oversights.
Additional revision rounds, structural changes, new requests, or ongoing changes after launch may be billed hourly.
5. Client Availability and Communication
Communication and support take place during normal business hours. Welwitschia Data aims to communicate promptly and professionally, but does not provide unlimited real-time availability unless a separate support arrangement explicitly states otherwise.
Clients are responsible for supplying timely feedback, approvals, content, access credentials, and payment confirmations when needed. Delays in any of these areas may affect delivery timing.
6. Support and Maintenance
Discounted projects, hourly projects, and installment-based projects do not include unlimited support. Ongoing support, maintenance, updates, content changes, and new feature requests are separate unless explicitly included in writing.
Maintenance arrangements, hosting support, and recurring update plans are quoted separately where applicable.
7. Project Delays
Delivery timelines depend on timely collaboration. Delays in content submission, approvals, feedback, scope clarification, or payment may delay project completion.
Where a project is delayed for reasons outside Welwitschia Data control, revised delivery dates may be issued.
8. Hosting and Domain Terms
Clients are responsible for purchasing their own domain unless another arrangement is explicitly confirmed in writing.
Hosting may be included for a limited promotional period where applicable. After any included hosting period ends, recurring hosting fees apply according to the agreed plan or current published rate.
9. Abuse, Fraud, and Revocation
Welwitschia Data reserves the right to revoke discounts, pause work, or cancel promotional eligibility where referral abuse, fraudulent representations, false claims, payment abuse, or other manipulative conduct is identified.
Any such revocation does not waive amounts already due for approved work completed or work already scheduled under a valid agreement.
10. Liability and Intellectual Property
Welwitschia Data is not liable for indirect, consequential, or incidental damages arising from the use of deliverables, except where required by law. Total liability is limited to the amount paid for the specific service in question.
Upon full payment, the client receives rights to the final approved deliverables for their project. Welwitschia Data retains rights to pre-existing tools, reusable code, internal frameworks, and generic delivery patterns.
