Terms of Service

Transparency is key to our partnerships. Here is exactly what you get, what it costs, and how we work together.

1. Services & Deliverables

We provide digital engineering and creative services. The specific scope of work is always defined in your project proposal or quote. Common deliverables include:

  • Web Design: Responsive websites built on modern frameworks (Next.js, React). Deliverable includes source code and deployed application.
  • Web Applications: Functional software with backend integration (databases, authentication).
  • Dashboards: Data visualization interfaces connected to agreed-upon data sources.
  • Data Analytics: Reports, insights, and data processing pipelines.
  • Graphic Design: Brand assets, logos, and UI designs (files provided in standard formats like SVG, PNG, PDF).

Monthly Service Specifications

For clients subscribed to recurring services, the following inclusions apply:

  • Hosting: Includes server infrastructure, SSL certification, daily backups, and uptime monitoring. Basic hosting covers shared environments; Advanced hosting provides dedicated resources and CDN integration.
  • Maintenance: Covers security patching, plugin updates, and health checks. Basic maintenance includes up to 2 hours of content updates/month; Full maintenance includes up to 5 hours/month and priority support.
  • Data Retainers: Provides continuous access to data specialists (Analytics, Science, Engineering) for ongoing reporting, model retraining, and pipeline management. Specific deliverables are defined in the Service Level Agreement (SLA).
  • Social Media Retainer: Includes content calendar creation, post scheduling, and community engagement for up to 3 platforms, plus monthly growth reporting.
  • Virtual Assistant: Dedicated administrative support for email management, scheduling, data entry, and basic research tasks.

2. Payment Structure

One-Time Project Fees

For standard projects (Packaged or Custom), a 50% deposit is required to commence work. The remaining 50% is due upon project completion and deployment to production. Work will not be released until full payment is received.

Monthly Retainers

Ongoing services (hosting maintenance, social media management, data retainers) are billed monthly in advance. Failure to pay may result in temporary suspension of services.

3. Client Responsibilities

To keep projects on schedule, clients agree to:

  • Provide necessary assets (logos, images, text) in a timely manner.
  • Provide prompt feedback on design drafts and prototypes (within 3-5 business days).
  • Grant access to necessary third-party accounts (domain registrars, existing hosting) if required.

6. Service Tier Definitions

One-time Services

  • Website Design – Basic: Up to 5 pages, responsive layout, contact form, basic SEO.
  • Website Design – Standard: 10–15 pages, CMS integration, blog/news, advanced SEO, integrations.
  • Website Design – Advanced: Custom features (e‑commerce/complex flows), performance optimization, accessibility.
  • Web Application – Simple/Medium/Complex: From CRUD apps to enterprise‑grade systems with auth, APIs, and real‑time features.
  • Dashboards – Basic/Advanced/Executive: From key metrics to executive KPI suites with scheduled refresh and export.
  • Data Analytics – Basic/Standard/Advanced: From monthly reports to predictive modeling and bespoke pipelines.
  • Data Science – Basic/Standard/Advanced: From exploratory models to production ML with governance.
  • Data Engineering – Basic/Standard/Advanced: From single pipelines to enterprise architectures with orchestration.
  • Training – Basic/Standard/Advanced: From two sessions to custom enterprise programs.

Monthly Services

  • Hosting – Basic/Advanced: Managed infrastructure, SSL, backups, monitoring; advanced includes dedicated resources/CDN.
  • Maintenance – Basic/Full: Security patching, updates; basic up to 2 hrs/month, full up to 5 hrs/month with priority support.
  • Social Media – Basic/Standard/Advanced: From 8 posts for 1–2 platforms to multi‑platform strategy with ads management.
  • Retainers (Analytics/Data Engineering): Ongoing expert capacity for reporting, pipelines, and enhancements.

Note: Hosting is required for web‑based projects and is owned and managed by Welwitschia Data.

4. Limitation of Liability

Welwitschia Data is not liable for indirect, special, or consequential damages arising out of the use or inability to use our deliverables. Our total liability is limited to the amount paid for the specific service in question. We do not guarantee specific marketing results (e.g., SEO rankings, sales conversion rates) unless explicitly stated as a performance-based agreement.

5. Intellectual Property

Upon full payment, the client owns the rights to the final visual designs and specific code written for their unique business logic. Welwitschia Data retains the right to reuse generic code libraries, utilities, and design patterns. We reserve the right to showcase the work in our portfolio unless a Non-Disclosure Agreement (NDA) is signed.
